TERMS AND CONDITIONS

Please read these Terms and Conditions ("Terms") carefully before using Messages: SMS

Messaging App (the "Application"), made available by Fusion Studio App ("Publisher",

"we", "us", "our"). Installing or using the Application constitutes your acceptance

of these Terms in their entirety. If you do not agree, please uninstall and

discontinue use of the Application.

PURPOSE OF THE APPLICATION

Messages: SMS Messaging App enables users to send, receive, view, and organize SMS

and MMS text communications directly from their mobile device. The Application may

include supplementary tools such as conversation folders, message search, notification

customization, and archiving.

WHO CAN USE THE APPLICATION

Use of the Application is intended for individuals who:

  (a) are legally permitted to enter binding agreements in their place of residence;

  (b) meet the minimum age requirement for mobile messaging services under local law;

  (c) will use the Application only for lawful personal or business communication

      purposes.

REQUIRED AND OPTIONAL PERMISSIONS

Depending on the features you choose to use, the Application may request the

following device permissions:

  - Default SMS handling  : required to send and receive text messages through the

                            Application

  - Contacts access       : used to associate incoming and outgoing numbers with

                            saved contact names

  - Media and file storage: used to attach and save photos, videos, or documents

                            shared in conversations

  - Push notifications    : used to alert you of new messages and activity

Permissions can be reviewed or withdrawn at any time through your device's settings

menu. Withdrawing a permission may limit certain features of the Application.

ACCEPTABLE USE

By using the Application, you agree that you will NOT:

  - Transmit unsolicited advertising, chain letters, or bulk unsolicited messages

  - Use the Application to harass, defame, threaten, or impersonate any individual

    or entity

  - Distribute content that is unlawful, fraudulent, obscene, or infringing upon

    third-party rights

  - Attempt to bypass, hack, or interfere with the security of the Application or

    connected networks

  - Use the Application in a manner that violates telecommunications or

    consumer-protection laws applicable to you

Fusion Studio App reserves the right to suspend or restrict use of the Application

for any user found in violation of this section.

MESSAGE CONTENT AND OWNERSHIP

All message content sent or received by you remains your own property. Fusion Studio

App does not author, endorse, or take responsibility for the substance of any personal

communication exchanged via the Application. Where optional backup or sync features

are enabled, associated data handling is described separately in our Privacy Policy.

CARRIER-RELATED CHARGES

Use of the Application depends on your device's SIM card and mobile network

connection. Fusion Studio App is not responsible for:

  - SMS/MMS charges, data usage fees, or roaming costs billed by your mobile carrier

  - Delivery delays, dropped messages, or service interruptions caused by network

    providers

  - Compatibility issues arising from your specific device or operating system version

You are advised to confirm your messaging plan details with your carrier prior to

extensive use.

INTELLECTUAL PROPERTY

The Application, including its source code, design elements, icons, and trademarks,

is the exclusive property of Fusion Studio App or its licensors. Subject to your

compliance with these Terms, you are granted a limited, revocable, non-exclusive

license to use the Application for personal or internal business purposes only.

You may not:

  - Decompile, reverse-engineer, or create derivative works from the Application

  - Copy, resell, rent, or sublicense the Application in whole or in part

  - Use Fusion Studio App's branding, name, or visual assets without express written

    consent

THIRD-PARTY SERVICES AND LINKS

The Application may interact with third-party services (for example, cloud storage

providers, sticker packs, or analytics tools). Such third-party services are governed

by their own terms and privacy policies, and Fusion Studio App accepts no

responsibility for their content, performance, or data practices.

PRIVACY

Our practices concerning the collection, storage, and use of your personal data are

detailed in our Privacy Policy, which is incorporated into these Terms by reference.

Continued use of the Application signifies your consent to those practices.

UPDATES AND MODIFICATIONS

Fusion Studio App may, at its discretion:

  - Release updates, patches, or new versions of the Application

  - Add, modify, or discontinue features without prior notice

  - Temporarily suspend the Application for maintenance purposes

We are not liable for any disruption resulting from such changes.

SUSPENSION AND TERMINATION

We reserve the right to suspend or terminate your access to the Application at any

time, without notice, if we determine, in our reasonable judgment, that you have

violated these Terms or engaged in conduct harmful to other users, third parties, or

Fusion Studio App.

DISCLAIMER OF WARRANTIES

The Application is provided on an "as is" and "as available" basis, without

warranties of any kind, whether express or implied, including warranties of

merchantability, fitness for a particular purpose, or non-infringement. Fusion Studio

App does not guarantee uninterrupted, timely, secure, or error-free operation of the

Application.

LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Fusion Studio App shall not be

liable for any indirect, incidental, special, consequential, or punitive damages —

including but not limited to loss of messages, data, goodwill, or profits — arising

out of or related to your use of the Application. Nothing in these Terms shall limit

liability that cannot be lawfully excluded, including liability for death, personal

injury, or fraud.

CHANGES TO THESE TERMS

Fusion Studio App reserves the right to amend these Terms at any time. Material

changes will be communicated through an in-app notice or updated store listing. Your

continued use of the Application after such changes take effect constitutes acceptance

of the revised Terms.

GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws applicable

to Fusion Studio App's principal place of business, without regard to conflict-of-law

principles.
